By accessing mydocmaker.com or downloading, installing or using MyDocMaker (the “Software”), you agree to these Terms of Service. If you do not agree, please do not use the website or the Software.

2. The Software license

Your right to use the Software is governed by its license terms, not by these website terms:

• Free for non-commercial use — personal, charity, educational, research and government use is licensed under the PolyForm Noncommercial License 1.0.0.
• Commercial use requires a paid license. See our pricing page and the license overview for details.

Where these Terms conflict with the applicable Software license, the Software license governs your use of the Software.

3. Acceptable use

You agree not to:

• use the Software for unlawful purposes or to infringe others’ rights;
• use it commercially without a valid commercial license;
• remove or alter any proprietary notices;
• misrepresent the authenticity of a signed document or use signing features to commit fraud.

4. Your documents and content

You retain all rights to the files and documents you create with the Software. Because the Software runs locally, we do not receive or store your content, and you are responsible for it and for keeping your own backups.

5. Intellectual property

MyDocMaker, the MyDocMaker name and logo, and the website content are owned by Hay & Wilson LLC and protected by applicable laws. The Software’s source code is made available under its stated license.

6. Third-party services

Downloads and source code are hosted on GitHub, and payments or other services may be handled by third parties. Their terms and privacy policies apply to those services.

7. Disclaimer of warranties

The website and Software are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Software is error-free or that any electronic or digital signature will be legally valid or enforceable in your jurisdiction — you are responsible for confirming signature requirements that apply to you.

8. Limitation of liability

To the maximum extent permitted by law, Hay & Wilson LLC will not be liable for any indirect, incidental, special or consequential damages, or loss of data, profits or goodwill, arising from your use of the website or Software. Nothing in these Terms limits liability that cannot be limited by law.

9. Indemnity

You agree to indemnify Hay & Wilson LLC against claims arising from your misuse of the website or Software or your breach of these Terms.

We may update these Terms or discontinue the website or features at any time. Continued use after changes means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the operator's home jurisdiction in the United States, without regard to conflict-of-law rules.
